Unlike criminal profiling, racial profiling is not considered a legal reason to stop the vehicle. As del Carmen and Hemmens explains, racial profiling is “any act by the police that depends on a person’s race, ethnicity, or national origin rather than individual actions or behavior.” Based on the Fourteenth Amendment, racial profiling is unconstitutional because it violates the equal protection clause. While racial profiling is a violation of citizens’ rights, criminal profiling is a legal instrument used to arrest criminals.
