Hamlet did not really have proof of the crime. The truth is, the fact that Claudius is guilty was not enough to justify what he did. Executing a person should be a perfectly informed decision, if something should come about this, rather than any reasonable suspicion of guilt. Hamlet makes a scene in the play in order to provoke Claudius’ reaction, but even if he was certain, that does not mean that there was any actual proof of it.
